You might have read Andhra Pradesh High Court scolded Central Government,
after hearing their casual argument on 4.5 per cent sub-quota to
minorities carved out of 27 per cent OBC reservation.
This reservation was designated as "heterogeneous" and found to be based on pure religious grounds; hence "unconstitutional".
Hon'able High Court concluded that - Office Memorandum(OM) creating the
sub-quota was based on religious grounds and not on any other
consideration.
In public terms - it was minority appeasement.

The main motive was the policy of Muslim appeasement - Congress wanted 9
% reservation for Muslims and Mulayam Singh wanted 18% reservation for Muslims.
Had there been no 50% Max limit on Reservations, Congress party and
Mulayam Singh Yadav would have promised 75% quota for Muslims.
Muslims are backward because they follow the rules of Quaran which are
dated back to 600AD. Most Shariah law practices are dated back to 600AD -
covering face and not educating girl children are some examples.
The December 22, 2011 OM for a sub quota of 4.5 per cent for socially
and educationally backward classes of citizens belonging to minority
communities out of the 27 per cent reservation for OBCs in central
educational institutions and jobs was announced by the Centre ahead of
the Assembly elections in five states including Uttar Pradesh and
Punjab.
In both places they lost.
AP High Court inferred that - "No evidence has been shown by the
learned Assistant Solicitor General to justify the classification of
these religious minorities as a homogeneous group or as more backward
classes deserving some special treatment.Therefore, they inferred that
Muslims, Christians, Sikhs, Buddhists and Zoroastrians (Parsis) do not
form a homogeneous group but a heterogeneous group.

Why Religious based reservation is wrong ?
As such Reservation should stop after a generation. While it is social justice for some - it is injustice for talented individuals, who missed a better career just because of their caste.
Also, in Indian subcontinent, Muslims ruled more than 1000 years. Still
they are backward. The prime reason is Shariah law which is incompatible
with modern civil right laws. Polygamy is banned in USA but in India -
that is legal. More uneducated wives, more children = "backwardness". A small family of 4 (1 educated wife, 2 kids ) with a decent pay of 25000 per month = "prosperity"
This is not some historical wrong done to SC/ST or OBCs by Brahmans.
Muslims were never an oppressed community. They just feel that going
backward towards 600AD is a good religious decision. So, why would
others suffer and sacrifice for a community with a backward outlook ?
When comes to vote - Muslims do smart voting as a group. So, there is a
race among politicians to grab Muslim vote by appeasing them with
unconstitutional reservations.
